Your brand name and logo are among your most valuable assets — but in the Philippines, rights generally go to the first to register, not the first to use. Securing your mark with the Intellectual Property Office of the Philippines (IPOPHL) is what protects you from imitators and disputes down the line.

Start with a clearance search Before you file, check whether a similar mark already exists in your classes. A clearance search is the single best way to avoid investing in a brand you can’t protect — or, worse, infringing on someone else’s. It costs far less than discovering a conflict after launch.

File in the right classes Trademarks are registered against specific classes of goods and services under the Nice Classification. Filing in the correct classes — and only the ones you actually need — keeps your application efficient and your protection meaningful.

Respond to office actions After filing, an examiner may raise questions or objections in an "office action." Responding properly and on time is what carries your application through to a Certificate of Registration; a missed response can cause the whole application to lapse.

Keep your registration alive A Philippine trademark is valid for ten years and renewable, but you must file the required Declarations of Actual Use to maintain it. Tracking those deadlines protects the rights you worked to secure.

Treat it as an asset A registered mark can be licensed, franchised, or enforced against copycats — but only if it’s properly filed and maintained. Building that protection early is one of the highest-leverage things a growing brand can do.
